Terms of Service

1. Agreement
These terms are between you and Buildalytic Inc. ("we", "us"), and they govern your use of Data Analysis App — the website, the analysis service, and everything it produces for you.
You accept them by creating a project or an account. If you are using the service for an organisation, you confirm you are authorised to accept them on its behalf.
The privacy policy forms part of these terms. Where the two appear to conflict about how we handle your data, the privacy policy governs.
2. Eligibility
You must be 18 or over to use Data Analysis App. We do not knowingly provide the service to anyone younger.
You must not use the service if you are barred from doing so under the laws applying to you, or if you are located in a jurisdiction subject to sanctions that would make providing it to you unlawful.
3. Accounts
You can start a project without an account. Creating one lets you keep your projects, return to them, and control how long your files are retained.
You are responsible for activity under your account. Keep your sign-in method secure and tell us promptly if you believe someone else has access.
We may suspend an account that is being used to breach these terms, that is generating costs far outside normal individual use, or where we are required to by law. Where suspension is our decision rather than a legal requirement, we will tell you why and give you a route to respond.
4. Your data stays yours
You keep all rights in the files you upload and in everything the service produces from them. We claim no ownership of either.
We do not use your data to train models, ours or anyone else's, on any plan. There is no setting for this because there is no other setting.
We do not sell your data, and we do not share it with advertisers or data brokers.
5. The permission you give us
To provide the service, you grant us a limited licence to store, process, copy and transform your files — strictly for the purpose of producing your project and supporting you with it.
That licence exists only to run the service. It does not permit us to publish your data, use it for our own analysis, or show it to anyone outside the circumstances described in the privacy policy. It ends when you delete the data.
You confirm you have the right to upload what you upload. If a file contains other people's personal data, you are responsible for having a lawful basis to process it.
6. What the results are, and are not
The service produces analysis: findings, figures, charts, written summaries and cleaned data. Every figure is traceable to the rows it came from, and every finding carries its calculation, its checks and its limitations.
It is not professional advice. It is not financial, legal, tax, medical or investment advice, and it is not a substitute for someone qualified who is accountable to you. Decisions you take remain yours.
Analysis depends on the data you provide. Incomplete, mislabelled or unrepresentative input produces analysis with the same defects, however well the calculations are performed.
We state confidence and limitations on findings because they are real. A finding presented at 96% confidence is not a guarantee, and a limitation we have named is one we expect you to weigh.
7. Human verification
Human Verified is an optional paid add-on. A reviewer independently checks the primary calculations, the metric definitions and the major findings, and records what they checked.
It is a review of the analysis, not an audit of your business, and not a professional opinion. It does not certify that your underlying data is accurate or complete.
Reviews are normally returned within one business day. If we cannot complete one, the add-on is not charged.
8. Acceptable use
Do not upload content you have no right to upload, or content that is unlawful.
Do not use the service to build a competing service, to systematically extract our outputs for resale, or to train a model on what it produces.
Do not attempt to bypass access controls, probe the infrastructure, or reach data belonging to anyone else. Genuine security research reported in good faith is welcome and is covered on the security page.
Do not automate access outside any documented interface, or place load on the service that is out of proportion to individual use.
9. Payments
Prices are shown before you pay and are in US dollars unless stated otherwise. Taxes may be added depending on where you are.
Payments are processed by Stripe. We never receive or store your card number.
If a payment fails, the project stays where it is and nothing is lost — you can retry. We do not silently downgrade or delete work over a failed payment.
10. One-time projects
Buying a project unlocks that project's outputs for your account, including follow-up questions and revisions to that same analysis.
It is a one-time purchase. There is no recurring charge, and nothing expires because you stopped paying — your access to a purchased project is governed by your retention settings and by account deletion, not by a subscription.
Asking the service to redo an analysis without a segment, or to change the presentation audience, is part of the project you bought rather than a new purchase.
11. Subscriptions
Subscriptions are not currently offered. The service is available through one-time project purchases.
If subscriptions are introduced, the checkout will state the exact capacity, recurring features, renewal period and cancellation terms before any charge. Those displayed terms will form part of this agreement.
No subscription begins without your express confirmation in checkout.
12. Final purchases
Project purchases and add-ons are final once delivered.
Nothing in this section limits rights that applicable consumer law does not allow us to exclude.
13. Third-party services
Running the service means relying on other companies for hosting, payments, model inference, email, analytics and error monitoring. The privacy policy names each of them and what they do.
We choose them carefully and hold them to terms consistent with these, but we are not responsible for their outages, and an interruption at a provider can interrupt the service.
14. Intellectual property
The service itself — the software, the interface, the methodology and the brand — remains ours. These terms do not transfer any of it to you.
Everything the service produces from your data is yours to use however you like, including commercially, with no attribution required.
If you send us feedback or suggestions, we may act on them without obligation to you. We will not identify you as their source without asking.
15. Service availability
We do not currently offer an uptime commitment. The service is provided as it is available, and we will say so plainly rather than publishing a figure we are not contractually standing behind.
We may change, add or withdraw features. If a change removes something you have already paid for, we preserve it for your existing projects wherever technically possible.
Planned maintenance that will interrupt the service is announced in advance where we can foresee it.
16. Disclaimers
The service is provided “as is”. To the extent the law allows, we exclude implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that the service will be uninterrupted, that every analysis will suit your purpose, or that outputs will be free of error. What we do commit to is that every figure can be traced and checked.
Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
17. Liability
To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, loss of business, or loss of data that you have not asked us to retain.
Where we are liable, our total liability is limited to the greater of the amount you paid us in the twelve months before the claim, or one hundred US dollars.
Your statutory rights as a consumer are not affected, and where local consumer law gives you more than this section does, that law applies.
18. Termination
You can stop using the service at any time, and delete your account from your account settings. Deletion removes your projects, files and outputs on the schedule described in the privacy policy.
We may end this agreement if you materially breach these terms and do not fix it after we have told you, or if we are required to by law.
If we end it for a reason other than your breach, outputs you have already downloaded remain yours. Where possible, we provide time to download paid outputs before access ends.
19. Changes to these terms
We may update these terms. The version and effective date at the top of this page always identify the current one.
If a change materially affects your rights or how your data is handled, we will tell you at least 30 days before it takes effect rather than updating the page quietly.
Continuing to use the service after a change takes effect means accepting the updated terms. If you do not accept them, you can cancel renewal and delete your account.
20. Governing law
These terms are governed by the law of California, United States, and any dispute will be heard in the state and federal courts located in San Francisco County, California.
Nothing in that clause removes your right to bring a claim in your own country of residence where consumer law gives you that right.
